Terms of Service
These Terms of Service ("Terms") govern your use of pastryskincare.co.za and any purchase you make from Pastry Skincare (PTY) LTD. By accessing the site or placing an order, you agree to these Terms.
These Terms are written to comply with the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), and the Protection of Personal Information Act 4 of 2013 ("POPIA").

2. Eligibility
You must be 18 years or older, or have the consent of a parent or legal guardian, to make a purchase. By placing an order, you confirm that you meet this requirement and that the information you provide is accurate.
3. Accounts
You may create an account to make purchases easier. You are responsible for keeping your login details confidential and for all activity under your account. Notify us immediately at customer@pastryskincare.co.za if you suspect unauthorised use.
4. Products and product information
We take care to describe our products accurately, including ingredients, intended use, and directions. Skin responses can vary from person to person. Our products are cosmetics for external use and are not medicines or treatments. We always recommend a 24-hour patch test before full use, particularly for sensitive skin.
Photographs are illustrative. Product packaging and shade variations may differ slightly from images.
5. Pricing and payment
All prices are listed in South African Rand (ZAR) and are VAT-inclusive at the prevailing rate. Delivery fees are added at checkout and are not included in the displayed product price.
We accept the payment methods displayed at checkout. Payments are processed by our payment partners on a secure connection — we do not store full card details.
Despite our care, errors in pricing or product information can occur. If we discover a material pricing error after you place an order, we will contact you with the option to confirm the order at the corrected price or cancel for a full refund.
6. Order acceptance
Your order is an offer to purchase. We accept your order only when we send a dispatch confirmation. Up to that point, we may decline an order for reasons including stock availability, pricing errors, suspected fraud, or where delivery to your address is not feasible.
7. Delivery and risk
Our shipping options, delivery times, and fees are detailed in our Shipping Policy. Risk in the goods passes to you on delivery. Title passes once payment has been received in full.
8. Returns and refunds
Your rights to return, exchange, or refund are set out in our Refund and Returns Policy, which forms part of these Terms.
Nothing in these Terms limits your statutory rights under the CPA, including the implied warranty of quality (CPA Section 56) and the right to safe, good-quality goods (CPA Section 55).
9. Intellectual property
The website, our brand, logos, product names, photography, copy, and all other content are owned by Pastry Skincare (PTY) LTD or our licensors. You may not copy, reproduce, distribute, or create derivative works without our written permission, except where permitted by fair use or applicable law.
10. User content
If you submit reviews, photos, or testimonials, you grant Pastry Skincare a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with our products and marketing. You confirm that the content is your own, does not infringe anyone else's rights, and is honest and accurate.
We may moderate, edit, or remove user content at our discretion, including content that is unlawful, offensive, or misleading.
11. Acceptable use
You agree not to:
- Use the site for any unlawful purpose or in breach of these Terms
- Attempt to interfere with the operation, security, or integrity of the site
- Scrape, harvest, or use automated tools to extract content without our written permission
- Use the site to send spam, malware, or harmful content
- Misrepresent your identity or impersonate another person
12. Limitation of liability
To the maximum extent permitted by law, and subject always to your rights under the CPA, our liability arising from your use of the site or purchase of our products is limited to the amount you paid for the relevant product.
We are not liable for indirect, incidental, or consequential losses such as lost profits or loss of opportunity. We do not exclude liability for death, personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
13. Indemnity
You agree to indemnify Pastry Skincare (PTY) LTD against any claim, damage, or expense arising from your breach of these Terms or your unlawful use of the site, except to the extent caused by our own negligence or wrongdoing.
14. Force majeure
We are not liable for delays or failures caused by events outside our reasonable control, including acts of nature, courier disruptions, power outages, pandemics, civil unrest, government actions, or telecommunications failures.
15. Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.
16. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your purchase will be subject to the non-exclusive jurisdiction of the South African courts.
Before approaching a court, we encourage you to contact us at customer@pastryskincare.co.za so we can try to resolve the matter directly. You may also escalate consumer disputes to the Consumer Goods and Services Ombud (cgso.org.za) or the National Consumer Commission.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
18. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date below shows the latest revision. Material changes will be communicated via email or prominently on the site. Continued use of the site after changes constitutes acceptance.
